He says he regrets his words, but stands by the 30 day jail sentence.  In other words, this worthless human being's not sorry at all.

If you read it all the way to the end its obviously just media scaremongering. The guy got a 30 day sentence for getting kicked off the sex offender program. Not for his rape charge.



Standard article writing, put the stuff you don't want people to actually read at the bottom (like facts that hurt your story) because most people will only skim the first couple paragraphs.

The way the question sounded in my head made me laugh. But then I looked at the article... I swear there was a "throw up" smiley. I need it, because that article was horrible :(

And the plea deal was that he'd attend a sex offender treatment program, which he got terminated from after unsupervised visits.

Fact is, the sentence he got at all was too light, and the judge is still a terrible person for rationalizing his behavior.

I'm pretty sure it's just anti-Chinese propaganda.  A lot of countries in that part of the world hate each other almost as much as certain middle-eastern countries do, but you seldom hear about it  :shrug
I'm not arguing, I'm explaining why I'm right.

From what I understand, the original sentence was pretty typical (wasn't it around 15 years, plus some more punishments like the registry and the counseling and stuff?), but then this judge nullified that sentence by having him basically do a camp/rehab thing, with probation.  He violated his probation by spending unsupervised time with minors (family, I believe), and thus was supposed to be put in jail.  Then this judge reduces the time in jail for violating probation to 31 days, 1 of them already served.

Yes, it's messed up, and the guy should be in jail for a lot longer than he was, but this charge is completely different from the rape.  It's just that he shouldn't of had a chance because he should have been in jail.

Koreans have a pretty deep-seeded hate for China.  Apparently, there was some hoo-ha or another .... like 60 years ago or something. :shrug

The media really needs to start acting more responsibly.  They're trying to make it sound like the guy repeatedly raped and tormented her until she killed herself, which just doesn't add up.  It looks like one of those skeezy Student/Teacher high school relationships, but at the same time those ARE illegal in no small part due to the fact that the girl did wind up killing herself over this.  "Older than her chronological age" my ass.  She'd be alive if that were the case.

^ I have only read one report about the case, and nothing more.  There's a lot that doesn't seem to add up.  This is the Reuters piece about it that had a fair amount of facts:  link

On the one hand, the facts sound a lot like a statutory rape/student-teacher thing.  Like X-Codes said.  But, the guy was convicted of what is, according to Reuters, Montana's rape offense.  Not statutory rape, not sex with a minor, or any similar offense, but rape.  Hence the huge penalty that the judge essentially commuted. 

I haven't gone directly to the court documents, and I'm a little skeptical that they'd shed a whole lot of light on the matter.  It's possible that the judge thought that the defendant was being mischarged -- that it really was more of a statutory rape situation rather than an actual rape one.  But, there are much more considered mechanisms in place (JNOV, judgment notwithstanding verdict), and it's not really his call anyway.  The jury determines whether all the elements of the rape offense were proven. 

EDIT:  just realized he pled guilty, wasn't convicted at a trial.  Although that sort of confuses me more.  He had what looked like a sweetheart deal.  They have him pleading guilty to a major crime and are willing to let him off awfully light.  And, he couldn't even stick to that?  It's weird for the judge to remove the Sword of Damocles the State had to encourage his compliance.

The suicide angle is just added tragedy to what is an already appalling situation.  The Reuters article at least didn't seem to over-sensationalize it, though the facts are pretty sensational. 

And, I agree with Libertad, I was a bit shocked to read the plea deal.  Maybe the evidence against him was really weak?  So, prosecutors figured they'd get him off the streets without having to press their luck?  That's giving them an awful lot of benefit of the doubt, which isn't exactly supported by my experience.
