Freedom of Movement vs Rope Bindings

A red abishai is under the effects of Freedom of Movement, gets knocked unconscious, and is bound by ropes.  He wakes up, because the party want to talk to him.

Does FoM allow the devil to automatically escape from the rope bindings?

Secondly, the Abishai's tail sting deals damage, plus 2d6 fire damage.  While bound, can the devil attack the ropes, and thus burn through them, freeing himself?

As far as attacking the ropes, I would say so.  It will teach them to not use something flammable to bind a fire-affiliated monster.

Well, also, FoM let "enables you or a creature you touch to move and attack normally for the duration of the spell", so...whether you let the abishai "escape" from the rope bindings is up to you as a DM, I think, but abishai should be able to move and attack normally (Maybe taking the rope with him, or maybe escaping...)

No.  FoM allows
1) move and attack under the influence of MAGIC that impedes movement
2) resist or escape grapples and pins
3) move and attack while under water

So ropes still count.

Thanks for the replies.

The party Beguiler used Charm Monster on the abishai after they had knocked it unconscious* (they wanted to talk to it without the abishai hitting them with Suggestion every single round), and tied it up.  They have constructed a story that the abishai was under a compulsion and was hurting himself, so they tied him up to stop him from hurting himself.  The party is planning to keep the devil around for intel purposes, at least through the 9-day duration of Charm Monster.  The abishai is going along with the story for now (the beguiler is his friend) but doesn't fully believe it.  After a day of being tied up, he'll probably burn his way out, and just walk up behind the beguiler, and ask him what he's doing...

Role play will ensue.  ;)

*despite the fact they had been attacking it, the fact the Beguiler cast it on the abishai while it was unconscious caused me to deny the abishai the +5 bonus for being attacked by the caster or his allies.
